For foreigners, civil weddings in India are governed by the provisions of The Special Marriage Act (1954). There is a 30 day residency requirement, under the act. This means that, either the bride or the groom should have been residing in India for a minimum of 30 days prior to applying to the local registry office to get married. You have to get a certificate from the local police station as a proof for this. You must produce a ‘No Objection Letter’ to the matrimony officer from their Embassy or Consulate, and the proof of termination of any earlier marriages that may have taken place.

Once the notice is received from the respective foreign country, the partner in India will have to re-submit the form at the Marriage Registration Office. After the form is submitted, the parties must wait for the predetermined time of 30 days before which the marriage cannot be performed.
